Definition of terms

This privacy policy is based on the terms used in the European regulations and by the European regulatory authorities when adopting the General Data Protection Regulations (GDPR). Our privacy policy should be easy to read and understand for both the general public and our customers. To ensure this, we would like to describe and explain the terms used.

Personal data means any data relating to an identified or identifiable natural person (hereinafter referred to as "data subject"). Controller or processor (Art. 4 No. 7 GDPR)
The controller or processor is the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by national or European law, the controller or the specific criteria for its nomination may be provided for by national or European law.

Third parties (Art. 4 No. 10 GDPR)
Third party" means any natural or legal person, public authority, agency or any other person other than the data subject, the controller, the processor and the persons who, under the direct authority of the controller or the processor, are authorised to process data.

Consent (Art. 4 No. 11 GDPR)
Consent is any freely given, specific, unambiguous and unequivocal indication of the data subject's wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

III Collection of data

When you visit our website, various data records are processed by you. We can distinguish between the purely informative use of the website and the use of certain functions within the website.

The content and services on this website are not intended for persons under the age of 16. If you are under the age of 16, please do not enter or provide any personal data via the website.

a. Collection of (personal) data when using the website for information purposes only
Please note that no personal data is collected when using our website for purely informational purposes, where no registration or other transmission of data is required. This does not apply to data that your browser transmits to enable your visit to the website. Our web server temporarily stores each access locally in a log file.

The following data is collected:

This data is processed for the purpose of enabling the use of the website (establishing a connection) and for the purposes of system security, fault diagnosis and technical administration of the network infrastructure. The IP address is only analysed in the event of attacks on the network infrastructure or for other data and information security reasons.

b. Collection of personal data through the use of certain functions within our website

In addition to the purely informational use of the website, we offer certain services for which specific personal data is processed.

If you are asked to provide personal data on our website, e.g. when registering for one of our events, this data is provided on a voluntary basis. It is used to provide you with information and services in the context of your enquiry and to maintain the relationship with you as an interested party or customer. If the required information is not provided, we will unfortunately not be able to provide you with the corresponding offer, as we will not be able to process your enquiry.

Due to legal regulations, the Scheer GmbH website contains information that enables quick electronic contact and direct communication with us. Such personal data provided by you on a voluntary basis will be stored for the purpose of contacting you and processing your enquiry. If you would like to participate in one of our webinars, you must register for this event and provide us with your personal data. Your personal data will be used exclusively for planning (e.g. to contact you in the event of cancellation or postponement of the webinar) and conducting the webinar, unless you have given further consent to its use. In this context, please also note Section VI "Integration of services from external providers" - subsection LogMeIn, Inc. 7414 Hollister Avenue Goleta, CA 93117, USA of this privacy policy. The collection of your data in this context is based on our legitimate interest pursuant to Art. 6 para. 1 subpara. 1 f) GDPR. We have a legitimate interest in knowing to whom we pass on our skills and expertise in relation to products and services.

- Registration for an activity (event)
If you would like to take part in one of our events, you must register for this event and provide us with your personal data. Your personal data will be used exclusively for the planning (e.g. to contact you if the event is cancelled or postponed) and execution of the event as well as the possible processing of payment, insofar as the event is subject to a fee, unless you have given your further consent to its use. The collection of your data in this context is based on our legitimate interest pursuant to Art. 6 para. 1 subpara. 1 f) GDPR. We have a legitimate interest in knowing who is registering for an event organised by us or in cooperation with others. In addition, the collection of data, insofar as it relates to a chargeable event, is based on the fulfilment of the contract in accordance with Art. 6 para. 1 subpara. 1 b) GDPR.

- Access to white papers, case studies, information brochures, specialist articles, reports and studies as well as recorded webinars.
If you would like to access a white paper, case study, information brochure, technical article, report/study or one of our recorded webinars, you will need to register and provide us with your personal data for this purpose. Your personal data will be used so that we know to whom we are passing on our expertise and know-how for our products and services and so that we can contact you if necessary. The collection of your data in this context is based on our legitimate interest in accordance with Article 6(1)(1)(f) of the GDPR, and the establishment of contact in accordance with Article 6(1)(1)(a) of the GDPR.

In principle, we process your personal data in the application process at your request in accordance with Article 6 (1b) GDPR, Article 88 (1) GDPR in conjunction with Section 26 (1) BDSG for the purpose of carrying out the application process. You are neither legally nor contractually obliged to transmit your data to us. As we require information about you as part of the application process, failure to provide it may mean that we are unfortunately unable to consider you in the application process.

You can apply directly as an applicant for the advertised positions via our online application portal. A corresponding registration process is required for this. When entering your online application, you can view, delete, block and release your data at any time. We will inform you about data processing in the application process at the beginning of the registration process.

 

IV. Processing of data within the group of companies

Within the responsible company departments, only those departments that require access to your data to protect our legitimate interests or to fulfil our contractual and legal obligations will have access to it.

V. Newsletter

You have the option of registering to receive our newsletter.

The data collection in the context of the newsletter dispatch is based on your voluntary consent in accordance with Art. 6 para. 1 subpara. 1 GDPR. You give us this consent as part of a double opt-in procedure so that we can check whether you are the owner of the e-mail address provided and agree to receive the newsletter. VI Inclusion of services from external providers

Individual pages of our website contain content provided by third parties. In these cases, your IP address is recognised by third parties in order to make the information available to you. These third parties receive your personal data, whereby the processing of your data outside the EU cannot be ruled out.

The transfer of personal data is independent of whether you have a user account with the third party and whether you are logged in to it. In cases where a user account exists and you are logged in, it must be assumed that your data will be assigned to your user account. To prevent this, you should log out of the third-party site.

The service enables the booking of a personal or telephone consultation appointment with an employee of Scheer GmbH (e.g. for a consultation before and / or after the conclusion of a contract).

The connection to the service is only established if you actually make an appointment using the online booking function via Microsoft Bookings (e.g. via a link or button on our website, in an email or in the newsletter). VIII Online marketing

We process personal data for the purposes of online marketing, which may include in particular the marketing of advertising space or the display of advertising and other content (collectively referred to as "content") based on the potential interests of users and the measurement of its effectiveness.

For these purposes, so-called user profiles are created and stored in a file (so-called "cookie") or a similar procedure, in which the user information relevant for the presentation of the aforementioned content is stored. This information may include, for example, the content viewed, the websites visited, the online networks used, the communication partners and technical information such as the browser used, the computer system used and information about usage times. If users have consented to the collection of their ancillary data, this can also be processed.

The IP addresses of users are also stored. However, we use designated IP masking procedures (i.e. pseudonymisation by shortening the IP address) to ensure user protection by using a pseudonym. In general, no unique user data (such as e-mail addresses or names) is secured as part of the online marketing process, but pseudonyms are. This means that neither we nor the providers of online marketing processes know the actual identity of the users, but only the information stored in their profiles.

The information in the profiles is usually stored in cookies or similar storage methods. These cookies can later, usually also on other websites that use the same online marketing technology, be read and analysed for content display purposes and supplemented with other data and stored on the server of the online marketing technology provider.

In exceptional cases, unique data may be assigned to the profiles. This is the case, for example, if the users are members of a social network whose online marketing technology we use and the network links the users' profiles with the aforementioned data. Please note that users may enter into additional agreements with the providers of social networks or other service providers, e.g. by giving their consent as part of a registration process.

In principle, we only have access to summarised information about the performance of our advertising. However, as part of the so-called conversion measurement, we can check which of our online marketing processes have led to a so-called conversion, i.e. to the conclusion of a contract with us. Conversion measurement is used solely to analyse the success of our marketing activities.

Unless otherwise stated, please note that the cookies used are stored for a period of two years.

Information on the legal basis: If we ask users for their consent (e.g. as part of a so-called "cookie banner consent"), the legal basis for the processing of data for online marketing purposes is this consent. Otherwise, user data is processed on the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offering. In this context, we also refer to the information on the use of cookies in this privacy policy.

Google Analytics target groupsWe use Google Analytics to display adverts placed by Google and its partners to users who have shown an interest in our online services or who have certain characteristics (e.g. interests in certain topics or products determined on the basis of the websites visited), which we transmit to Google (so-called "remarketing audiences" or "Google Analytics audiences"). With the help of remarketing audiences, we also want to ensure that our adverts correspond to the potential interest of users.

Facebook Pixel and customised target groups (customised target groups)With the help of the Facebook pixel (or equivalent functions to transfer event data or contact information via interfaces or other software in apps), Facebook is able to determine the visitors to our online services as a target group for the display of adverts (so-called "Facebook ads"). Accordingly, we use the Facebook pixel to display Facebook adverts placed by us only to Facebook users and within the services of partners cooperating with Facebook (so-called "Audience Network"). https://www.facebook.com/audiencenetwork/ ) who have shown an interest in our online services or who have certain characteristics (e.g. interests in certain topics or products that are determined based on the websites visited), which we transmit to Facebook (so-called "Custom Audiences"). The Facebook pixel also enables us to track the effectiveness of Facebook adverts for statistical and market research purposes by showing whether users were redirected to our website after clicking on a Facebook advert (known as "conversion tracking").

We are jointly responsible (so-called "joint controllership") with Meta Platforms Ireland Ltd. for the collection or transmission (but not the further processing) of "event data" that Facebook collects or receives as part of a transmission using the Facebook pixel and comparable functions (e.g. APIs) implemented in our online services for the following purposes or received in the context of a transmission: a) Display of advertising content that corresponds to the presumed interests of users; b) Delivery of commercial and transactional messages (e.g., Facebook Messenger), addressing users via Facebook Messenger); c) improving ad delivery and personalisation of features and content (e.g. improving the recognition of which content or advertising information is likely to be of interest to users). We have entered into a special agreement with Facebook ("Controller Addendum"), https://www.facebook.com/legal/controller_addendum), which deals specifically with the security measures that Facebook must take (https://www.facebook.com/legal/terms/data_security_terms) and where Facebook has agreed to respect the rights of data subjects (i.e., users can submit requests for access to information or deletion directly to Facebook, for example). Note: When Facebook provides us with measurements, analyses and reports (which are aggregated, i.e. do not contain information about individual users and are anonymous to us), this processing is not carried out under joint responsibility, but on the basis of a DPA ("Data Processing Agreement"), https://www.facebook.com/legal/terms/dataprocessing), the "data security conditions" (https://www.facebook.com/legal/terms/data_security_terms) and, with regard to processing in the USA, on the basis of standard contractual clauses ("Facebook EU Data Transfer Addendum, https://www.facebook.com/legal/EU_data_transfer_addendum).
